There are those who argue that since Islam permits Muslim men to have sexual intercourse with their slave girls, this then means that they also have the right to rape them.
This is absurd. The right to have sex with a woman does not necessarily imply that one has the right to rape her as well. To say that a Muslim man has the right to rape his slave girl is like saying that a man has the right to rape his wife; which is not true.
Rape in Islam is completely forbidden.

This is just absurd hair splitting. A woman can consent if she feels she is at parity, so a slave’s consent, if the slave is a woman, is an absurd construct altogether. Sex without consent is rape.

I cannot imagine a situation where a slave would have the right to refuse? Why not check the Slave Charter, revised edition 2011?, the answer should be found in Chapter 6, Conjugal Relations with Slave and Bonded Women.

truest, so you may choose either of two things; the war prisoners or the
wealth, for I have delayed their distribution.”
…….. The people returned and their leaders spoke to them, and then came
to Allah’s Apostle and said, “All the people have agreed willingly to do
so and have given the permission to return the war prisoners (without
Compensation)” (Az-Zuhri, the sub-narrator states) This is what has been
related to us about the captives of Hawazin.
FREEING SLAVE
5 :89 Allâh will not punish you for what is uninentional in your oaths,
but He will punish you for your deliberate oaths; for its expiation (a
deliberate oath) feed ten Masâkin (poor persons), on a scale of the
average of that with which you feed your own families; or clothe them;
or manumit a slave.
9:60.
As-Sadaqât (here it means Zakât) are only for the Fuqarâ’ (poor), and
Al-Masâkin (the poor) and those employed to collect (the funds); and for
to attract the hearts of those who have been inclined (towards Islâm);
and to free the captives; and for those in debt; and for Allâh’s Cause
(i.e. for Mujâhidûn – those fighting in the holy wars), and for the
wayfarer (a traveller who is cut off from everything); a duty imposed by
Allâh. And Allâh is All-Knower, All-Wise.
90: 10. And shown him the two ways (good and evil)?
11. But he has made no effort to pass on the path that is steep.
12. And what will make you know the path that is steep?

8:67.
It is not for a Prophet that he should have prisoners of war (and free
them with ransom) until he had made a great slaughter (among his
enemies) in the land. You desire the good of this world (i.e. the money
of ransom for freeing the captives), but Allah desires (for you) the
Hereafter. And Allah is All-Mighty, All-Wise.
47: 4. So, when you meet (in fight Jihad in Allah’s Cause), those who
disbelieve smite at their necks till when you have killed and wounded
many of them, then bind a bond firmly (on them, i.e. take them as
captives). Thereafter (is the time) either for generosity (i.e. free
them without ransom), or ransom (according to what benefits Islam),
until the war lays down its burden.

and let those who find not the financial means for marriage keep
themselves chaste, until Allah enriches them of His Bounty. And such of
your slaves as seek a writing (of emancipation), give them such writing,
if you know that they are good and trustworthy. And give them something
yourselves out of the wealth of Allah which He has bestowed upon you.
And force not your maids to prostitution, if they desire chastity, in
order that you may make a gain in the (perishable) goods of this worldly
life. But if anyone compels them (to prostitution), then after such
compulsion, Allah is Oft-Forgiving, Most Merciful (to those women, i.e.
He will forgive them because they have been forced to do this evil
action unwillingly).

Yahya said that he heard Malik say, “What is done in our community about
the man who rapes a woman, virgin or non-virgin, if she is free, is
that he must pay the bride-price of the like of her. If she is a slave,
he must pay what he has diminished of her worth. The hadd-punishment in
such cases is applied to the rapist, and there is no punishment applied
to the raped woman. If the rapist is a slave, that is against his master
unless he wishes to surrender him.”

By Allah, I found this in the days of ignorance that a person grazed the

It his been narrated through a different chain of transmitters, on the
authority of Hudhaifa b. al-Yaman who said: Messenger of Allah, no
doubt, we had an evil time (i. e. the days of Jahiliyya or ignorance)
and God brought us a good time (i. e. Islamic period) through which we
are now living Will there be a bad time after this good time? He (the
Holy Prophet) said: Yes. I said: Will there be a good time after this
bad time? He said: Yes. I said: Will there be a bad time after good
time? He said: Yes.

The Prophet said, “The most hated persons to Allah are three: (1) A
person who deviates from the right conduct, i.e., an evil doer, in the

Ibn Abbas reported that Allah’s Apostle (may peace be upon him) said to
Ma’iz b. Malik: Is it true what has reached me about you? He said: What
has reached you about me? He said: It has reached me that you have
committed (adultery) with the slave-girl of so and so? He said: Yes. He
(the narrator) said: He testified four times. He (the Holy Prophet) then
made pronouncement about him and he was stoned (to death).

written whom He is going to create till the Day of Resurrection.”
Qaza’a said, “I heard Abu Sa’id saying that the Prophet said, ‘No soul
is ordained to be created but Allah will create it.”

Jabir reported that ‘Abdullah b. Ubayy b. Salul had two slave-girls;
one was called Musaika and the other one was called Umaima and he
compelled them to prostitution (for which’Abdullah b. Ubayy b. Salul
compelled them). They made a complaint about this to Allah’s Messenger
(may peace be upon him) and it was upon this that this verse was
revealed:” And compel not your slave-girls to prostitute” up to the
words:” Allah is Forgiving, Merciful.”

The Qur’an does provide permission for those who wish to marry slave women (4:27). Indeed, the Prophet had said that such marriages will confer a double reward. ‘He who provides the slave woman under him with proper manners, provides her with the best education, then frees her and ultimately marries her will be given a double reward.” (Bukhari, Muslim)
The guardian of the slave is the master whether it be a male or a female slave. The guardianship of the slave woman who is under a male master rests with that man. Even if she is to be married off, it is he who will have to carrry it out. It is also he who is to take care of all her affairs. It is for this very reason that there is not the need for the act of marrying her. In Islam, marriage is a contract that is solemnized by the guardian of the woman and the bridegroom. In this case, he is both the master and bridegroom. Then the marriage ceremony becomes irrelevant in itself.
The Qur’an instructs that the maximum number of wives for a man must be four (4:3). Let us suppose that there is a slave woman under the care of a man who has four wives He cannnot, in that case, marry her. If he is not ready to grant her freedom, liberation from dependence will remain for her a dream. She will then be forced to resort to adultery in her bid to satisfy her sexual desire. But since there is the law that the master can engage in sexual relations with her without recourse to marriage, a solution for all such problems manifests itself. It becomes possible for her to walk into freedom when she gives birth to her master’s child. It will also be the solution for her sexual needs. In a society where slavery prevails, if a solution is not provided for such problems it will lead to a large scale erosion of values. Along with this, there will also be the problem of the children born from adulterous relationships. Naturally, they ,too,will end up as slaves. The end result of all this will be that slavery becomes entrenched as a system that can, is, no wise, be terminated.
In the case of Islam, however, the provision is made such that the masters are permitted to have sexual relations with woman slaves, whereby, within the span of a single generation, slavery is made extinct. If ‘marriage’ is made a condition for it, it is not possible then to obtain the results envisaged by Islam. Certainly, all masters would not be willing to marry their slaves woman Besides, it is impossible for those who already have four wives.
